Dangerous DUI Statistics, and Lindsay Lohan

| No Comments | No TrackBacks

Lindsay Lohan's DUI case in Los Angeles has become an ongoing lesson in how complicated a drunk driving conviction can be for you, both now and in the future.  Lindsay Lohan was charged with Multiple DUI Convictions, bringing about some dangerous consequences for her.  She went to prison, then to a mandatory rehab facility, costing her a little over a month of her freedom, a great deal of public shame and hundreds of thousands of dollars in legal fees.

While Lindsay Lohan is an actress who can afford to miss a month of work because of the type of schedule she has, the typical person could not afford to miss one week of work, let alone one month, due to jail and rehab time.  The severe consequences in store for anyone charged with drunk driving and Multiple DUI Convictions should be enough to make anyone accused of driving under the influence to seek out a top notch LA DUI Defense Attorney right away.  Lohan had two different lawyers defend her, both of whom worked quite hard to provide Ms. Lohan with the best defense possible, including the best experts money could buy and much more.

A recent study done by the National Highway Traffic Safety Administration (NHTSA) reported that there are 17 million drunk drivers every year.  In fact, one in twelve people admitted to driving drunk at least once a year, meaning there will not only potential for a few DUI charges, but countless Multiple DUI Convictions.  One in five people admit to hitting the road just two hours after drinking, while a quarter of drunk drivers report drinking three times a week or more.  Such studies will lead to increased penalties on drunk driving, more severe penalties for those with Multiple DUI Convictions and increased pressure on federal and state governments to stiffen fines for such people.

Whether or not the numbers are justified, the NHTSA claims that if they could cut all drunk driving and have 100 percent seat belt usage, vehicle fatalities would be cut in half at least.  Such powerful statements can seriously influence Congress, state legislatures, police departments and more.  Such individuals are under enormous public pressure to listen to lobbying organizations such as Mothers Against Drunk Driving (MADD) and studies such as these fuel their fire.

The Ongoing Los Angeles DUI Saga for Lindsay Lohan

| No Comments | No TrackBacks

Former teen music and movie star Lindsay Lohan has an ongoing drunk driving saga that has lasted almost as long as her career.  After being sent to prison earlier this summer for Multiple Los Angeles DUI convictions, she was then sent to a rehab facility where she was to spend 90 days getting counseling and training on how to stay clear from drugs and alcohol.  However, after the original judge recused herself due to improper contact with people involved in the case, it appears Lohan may be able to cut short her stint in rehab.

Lindsay Lohan's Los Angeles DUI Defense Attorney is trying to get her out of rehab by August 25, as she has reportedly done very well during her time at the UCLA rehab clinic where she was sent.  The new judge, Hon. Elden Fox, listened to reports from Lohan's Los Angeles DUI Defense Attorney, the prosecutor in the case, the doctors who have been treating Lohan as well as other experts.  Although no word yet has been released, Lohan stands a good shot of getting out of rehab prior to the full 90 days she was sentenced to spend there.

With a highly skilled Los Angeles DUI Defense Attorney working for you, there is not reason you should be at the total mercy of any judge, prosecutor or even a jury. A knowledgeable, experienced lawyer will be able to work hard on your behalf to cut down any sentencing and to help you find ways of complying with court orders to cut sentencing short.  For example, if you willingly submit yourself to a rehab program before sentencing, you may be able to avoid going to jail, going to mandatory counseling, going to a rehab facility chosen by the court, etc.  An attorney with experience in DUI trials can help you understand how to comply with the courts in such a way that your sentence becomes lighter.

In Lindsay Lohan's case, she has Multiple Los Angeles DUI convictions, meaning the court has seen a pattern of poor behavior, not just one bad mistake.  As a result, she will have to prove that not only is she sorry for what she has done, but she is working to build a lifestyle that no longer supports such bad behavior as drinking and driving.  With a skilled Los Angeles DUI Defense Attorney, you can have a great deal of guidance in trying to convince the court that you should not serve any jail time.  At Kestenbaum Eisner & Gorin, LLP, our lawyers know how to communicate with judges and how to battle against prosecution and law enforcement tactics.  Instead of waiting for the judge to send you to prison and/or worse, you can actively work to help yourself by getting help before hand.  Our lawyers can direct you to programs which are well received by the courts, and which will show the judge, prosecution and jury that you have been working to help your situation.

If you or someone you love has been arrested for, accused of or charged with driving under the influence of drugs or alcohol, contact the Los Angeles DUI Defense Attorneys at Kestenbaum Eisner & Gorin today.  A skilled lawyer may be the only friend you have when facing drunk driving charges.

DUI = Jail...For Life?

| No Comments | No TrackBacks

People dealing with prior convictions for DUI face much harsher penalties than others face.  They face shame, ridicule, increased jail time, increased fines and much more.  Multiple DUI convictions can also lead to losing your driver's license for years, mandatory counseling sessions and classes, calling your probation officer every day and much more.  In one instance, a man was given a life sentence after his 9th driving under the influence conviction.

A 54 year old man named Bobby Stovall of Round Rock, Texas was driving his truck in early June when he swerved through several lanes of traffic and hit another vehicle, injuring the other motorist.  Later, it was determined that Stoval had a blood alcohol concentration of .32, which is four time the legal limit in Texas and California.  The judge in the case seemed fed up with the man's 8 prior drunken driving convictions, and ordered the man to serve up a life sentence, which is unprecedented for drunk driving convictions.

Multiple DUI convictions are one of the most dangerous legal situations anyone can face in Los Angeles, even more severe than some felony convictions.  First off, Multiple DUI convictions can lead to a felony charge, and can restrict far more than a person's personal freedoms.  Limited career options, limited transportation options, years in prison, heavy fines, interlock devices placed on your car, having to be constantly monitored by the state and much more are all consequences of being charged with Multiple DUI convictions.

When you first sit down with a Los Angeles DUI Defense Attorney, explaining all of your multiple DUI convictions is a major priority.  Without a full understanding of your legal past, he cannot provide the kind of defense you need.  For each additional conviction, you face increased penalties.  For example:

  • Second offense: license suspension of up to 2 years, 96 hours to 1 year in county jail
  • Third offense: license suspension of up to 3 years, 4 months to 1 year in county jail
  • Fourth offense: license suspension of up to 4 years, 6 months to 3 years in county jail or state prison
  • All offenses may also include probation, alcohol classes or counseling, and fines of up to $1,000.

If you or someone you love has been charged with driving under the influence, or is facing Multiple DUI convictions, contact the Los Angeles DUI Defense Attorneys at Kestenbaum Eisner & Gorin, LLP by calling 877-781-1570 today.

Of Gooden's Multiple DUI Convictions, he was arrested in 2002 in Tampa for a DUI and for having an open container of alcohol in his vehicle.  He was arrested in 2005 for suspicion of DUI.  These types of convictions can sway a judge, prosecutor and/or jury, meaning that any sentence handed down could be severe and harsh.  Having a skilled Los Angeles DUI Defense Attorney by your side when facing Multiple DUI Convictions could be the difference between a slap on the wrist and three years in prison.

Los Angeles DUI Warrant Crackdown Coming to a Neighborhood Near You

| No Comments | No TrackBacks

The City of Los Angeles and the state of California are launching a serious crackdown on all outstanding DUI Warrants, in an effort to make people with prior DUI convictions pay for their alleged crimes.  The Statewide Traffic Records System found that while there were over 200,000 DUI arrests in 2008, there were a number of outstanding Los Angeles DUI warrants because many of those arrested failed to show up in court.

In an aggressive effort to find and punish violators, the California Highway Patrol is stepping up their efforts to prosecute anyone arrested for a DUI charge to failed to show up in court.

These Los Angeles DUI warrants may be difficult to prosecute, but serious jail time and heavy fines could land on the head of anyone found guilty of missing a court date.  The CHP will rein in those with outstanding DUI felony and misdemeanor arrest warrants by establishing teams of officers whose specific purpose is to serve Los Angeles DUI warrants throughout the state.  The funding for the "DUI Warrant Service Project" is provided by a $311,568 grant awarded by the California Office of Traffic Safety through the National Highway Traffic Safety Administration.

There are many reasons why someone arrested for DUI would fail to appear in court and be issued a Los Angeles DUI warrant.  A defendant may have a prior Los Angeles DUI arrest and feel that if they are charged they could lose their license, go to jail or be assessed a heavy fine.  However, avoiding court will not help you avoid jail; in fact, it could lead to more serious jail time if you are found in violation of a Los Angeles DUI warrant.

If you have been arrested for a DUI charged, you need a skilled, competent Los Angeles DUI defense attorney, someone with experience, skill and a successful track record of DUI defense.  At Kestenbaum, Eisner & Gorin, our Los Angeles DUI defense attorney team possesses decades of experience with DUI trials, as well as insider knowledge on prosecutor tactics.  As former attorneys in the LA District Attorney's Office, we know how the city and county will attempt to carry out those Los Angeles DUI warrants, as well as the best way to get positive results in court.

San Diego Chargers Receiver Vince Jackson Receives Jail Sentence After Guilty DUI Plea

| No Comments | No TrackBacks

San Diego Chargers receiver Vincent Jackson received a four day jail sentence and five years probation Monday after pleading guilty to a 2009 DUI charge.

This wasn't the first time that Jackson had been arrested for suspicion of driving under the influence. He also pleaded guilty to a DUI charge in 2006 and was on probation when he was arrested last January for suspicion of driving under the influence.

According to the City Attorney's Office, Jackson was given the standard sentence for a DUI with one prior, including a $2,408 fine and 10 days of public work service. He also was given an additional five days of public work service on the 2006 DUI charge.

With the guilty plea, Jackson likely will be subject to the NFL's personal conduct policy and could face at least a one-game suspension in the 2010 season.

Following a traffic stop, Jackson was handcuffed and had his car impounded hours before his team played the New York Jets in the playoffs earlier this year.  Jackson now waits to serve his jail and work service time.

Multiple Los Angeles DUI Convictions

If you have been charged with multiple Los Angeles DUI convictions, you are in danger of damaging your present and future driving freedoms, as well as potential job opportunities, family rights and much more.  Multiple Los Angeles DUI convictions can lead to a restricted license, jail time, heavy fines, having an interlock device put on your car, probation and more.

In a recent example of what can happen to you in a Los Angeles multiple DUI conviction scenario, a San Mateo man who was arrested for his seventh DUI on Saturday has pleaded not guilty to a felony drunken driving charge, a prosecutor said.

Antonio Gutierez, 42, entered his plea to driving under the influence and driving without a license charges Tuesday afternoon in San Mateo County Superior Court, according to authories. Gutierez is in jail in lieu of $100,000 bail.

Gutierez pulled over for speeding about 11:30 p.m. when officers believed he was under the influence and later ordered the suspect to take a blood test. According to authorities, they should have the results of that test in the next couple days. Gutierez didn't have a valid license at the time of his arrest, they added.

This is not Gutierez' first run in with the law; not only did he have two misdemeanor DUI arrests in 1993 and 1996, but was convicted another five times from 1999 to 2007, according to authorities. Drunken drivers typically must get three misdemeanor convictions before prosecutors can charge them with a felony so it is possible that this is his eighth DUI arrest. Gutierez has been convicted of felony DUI five times before and is due back in court Feb. 2.

Multiple Los Angeles DUI convictions are a serious matter as the consequences increase with each arrest and conviction. Typically, jail time becomes mandatory and increases with each DUI and misdemeanor DUI arrests become a thing of the past after a fourth DUI arrest. For this reason, an experienced and professional Los Angeles DUI defense attorney team is essential when fighting DUI charges in court. Prior DUI Convictions in Los Angeles

| No Comments | No TrackBacks

Pamela Bach, ex-wife of David Hasselhoff, has been charged with one count of driving under the influence and one count of driving with a BAC of .08 or higher.  She has prior DUI convictions.

Bach was arrested on November 28 and law enforcement officials said that she took breathalyzer tests and blew a .14 and .13.  Bach now faces a minimum of four days in jail if convicted.

She was taken to Van Nuys where she was booked and released. Bach said, "I am remorseful and mortified. I am going through a really difficult time between David being in the hospital and dealing with the divorce."

According to official documents, bail was set at $15,000. Bach said she was released on her own recognizance.

She was also busted for a prior DUI conviction in March 2009, pled no contest and was placed on probation. According to California law, a second DUI gets you mandatory jail time.

This is the latest in a string of incidents that Bach has been involved in this year. She is also being sued for a car crash she was involved in during her March 2009 DUI.

Mitchell Paulson claims Bach was driving under the influence when she slammed into his car and injured him, he is now seeking unspecified damages.

A second DUI offense in Los Angeles comes with much heavier consequences than a first time offense. Some of these consequences can include: three to five years of court probation, $1800 to $2800 in fines (some courts allow part of the fine to be worked off through community service), two year loss of drivers license (one year mandatory suspension, your lawyer may be able to obtain a restricted license after one year), installation of ignition interlock device (breath tester) on vehicle, 18 months of DUI School and mandatory jail time of at least 96 hours.  Prior DUI convictions in Los Angeles can lead to major headaches, especially if the defendant does not have proper representation, such as a qualified Los Angeles DUI defense attorney.

Bach faces a second DUI offense in Los Angeles and legal troubles connected to the crash during her first DUI in March. Unfortunately, DUI arrests and charges are a common occurrence in Los Angeles. Many times, however, there are inaccuracies in breathalyzer and field sobriety tests that may wrongly accuse or charge a person of a DUI in Los Angeles.

If you have been accused of a prior DUI conviction in Los Angeles, whether it is a first, second, third, or even fourth time offense, you need an experienced team to assist you in court. The experienced Los Angeles DUI defense team at Kestenbaum, Eisner & Gorin, LLP has over 50 years of courtroom experience and will work on your behalf to ensure you have a fair DUI trial in court.
