Another Celebrity Los Angeles DUI

| No Comments | No TrackBacks

Faith Evans, a singer and songwriter who also acts and produces, was arrested by the Los Angeles Police Department for allegedly driving under the influence.  According to law enforcement, Ms. Evans was stopped at a DUI checkpoint near Marina Del Rey when officers detected alcohol.  She was arrested and booked on suspicion of Los Angeles DUI; she was eventually released the following morning after her car was impounded.

After the Faith Evans DUI Arrest, she tweeted that she is fine and thanked fans for their support.  For most people living in Los Angeles however, a DUI Arrest could lead to much more than one night in jail and a wave of support from well wishers.

Evans is the former wife and widow of rapper Christopher "The Notorious B.I.G." Wallace.  In addition to being drawn into the East Coast/West Coast rap feud, Ms. Evans has been charged with other crimes, including possession of marijuana and cocaine as well as an improper tag violation during a traffic stop.

Most people charged with a Los Angeles DUI face serious consequences, including jail time, loss of license, probation, fines and more.  Without a skilled Los Angeles DUI Defense Attorney, you could be facing numerous parts of the criminal justice system without proper legal representation.  For example, if you have been arrested for a Los Angeles DUI, you are not only going to have to go through the courts, but you will most likely have a DMV hearing as well, which could cost you your license if you are not careful. The DMV has the authority to take away your license for years depending upon the type of drunk driving crime you are accused of.  In any DMV hearing, you need a skilled Los Angeles DUI Defense Attorney to help you navigate the hearing, the laws and how to help you keep your license.

When pulled over at the Sobriety Checkpoint, Faith Evans could have faced any number of investigations by the police.  She could have been given a field sobriety test (such as walking in a straight line or reciting her ABC's), she could have been given a breath test (to determine her blood alcohol content) or she could have simply been given a smell test (did her breath or car smell of alcohol).

If you or someone you love has been charged with drunk driving due to a Los Angeles Sobriety Checkpoint, contact the Los Angeles DUI Defense Attorneys at Kestenbaum Eisner & Gorin, LLP by calling 877-781-1570.  We will analyze your situation and provide top notch legal counsel on how to craft the best defense possible for your driving under the influence charge.

Drunk Driving and the NBA

When he played for the New Jersey Nets, Jayson Williams was known as an outstanding rebounder, a great defender and a tough competitor.  However, after a brutal incident involving his limo driver, Mr. Williams was sent to jail (even with a valiant effort by his criminal defense lawyer).  Now, it looks like a drunk driving conviction will add jail time to his current sentence, creating an even more complex scenario for the former NBA star.

Williams was sentenced to five years in prison for the shooting death of his former limo driver, and he is currently serving that sentence having reported in March of this year.  However, two months before his sentence began, he slammed his Mercedes Benz into a tree in New York City.  He plead guilty, through is DUI Defense Attorney, and was handed another year of jail time on top of his current sentence.  This is in addition to a fine of almost $17,000 for the tree he hit.  The limo driver shooting took place in 2002.

People under a great deal of stress can make poor decisions, and without a skilled Los Angeles DUI Defense Attorney looking out for your best interests, it is easy to fall prey to serious consequences.  For example, Jayson Williams was obviously concerned with how his jail sentence would affect him, his family, his future and more.  Under such stress and hardship, people of all backgrounds, professions and economic classes have made huge mistakes.  For someone in such a circumstance, only an experienced, top notch Los Angeles DUI Defense Attorney can provide the legal representation necessary to get the judge, prosecution and/or jury to understand.  Arguing your case before a judge can be the difference between 1 year in jail or just a fine, and you need a lawyer who understands how to make a great argument.

The Great Lindsay Lohan DUI Crusade

| No Comments | No TrackBacks

There may be no greater example of how not to handle a Los Angeles DUI than the Lindsay Lohan anti-fairytale.  Ms. Lohan was arrested for multiple DUI convictions, leading to prison time and not her mandatory rehab.

It was recently reported that Lindsay Lohan could be getting out of the UCLA Neuropsychiatric Hospital (where she is in rehab) as early as this week, which is not the full 90 days she was sentenced to.  Although Lindsay Lohan has not treated all of her Los Angeles DUI charges and convictions seriously, it seems she is abiding by the terms of her rehab and making noticable progress.  The doctors do not belief the drug dependency it was thought she was dealing with are as severe as they could have been.  The one obstacle Lohan faces, that her Los Angeles DUI Defense Attorney will have to work overtime to help her with, is that a judge has to sign off on the early release.  The Los Angeles DUI Defense Attorney Lindsay Lohan has hired can go back to court and ask the judge to release her client from the 90 day rehab sentence.

Lindsay Lohan's DUI trial, as well as the aftermath, was been quite unique, with her sobbing pleas in the courtroom, her obscene jewelry, the photo shoots which occurred just before her stint in jail and the judge in the case (Hon. Marsha Revel) removing herself from the case.  The prosecutor in the trial alleged that the judge had improper contact with people involved in the case.  The judge then recused herself and was replaced with Judge Elden Fox who presides in Beverly Hills as well as downtown.

In any drunken driving case, a skilled Los Angeles DUI Defense Attorney can help provide a unique defense, keeping you out of prison.  Even just a few days in jail could lead to a lifetime of problems, in your personal and professional life.  Having a Los Angeles DUI conviction on your record could prevent you from getting a loan, getting a job, living in certain areas and more.  These are just some of the reasons why a knowledgeable Los Angeles DUI Defense Attorney is so important.

At Kestenbaum Eisner & Gorin, LLP, our team of Los Angeles DUI Defense Attorneys can provide a top notch defense, keeping you away jail.  If you are facing such a conviction, contact us today at 877-781-1570.  We understand DUI laws, we work with some of the best experts in the legal field and we will provide an unmatched level of legal representation.  Whether you are a movie star like Lindsay Lohan, a housewife or just a regular working professional, we can help provide the kind of legal defense necessary to protect your reputation now and in the future.

Los Angeles DUI Penalties

| No Comments | No TrackBacks

Whenever someone charged with drunk driving sits down with a Los Angeles DUI Defense Attorney, he or she is facing serious consequences.  It is often hard to imagine being unable to drive your kids to work, or being unable to get to your own job, but if you are convicted of driving under the influence in Los Angeles, then you could face those consequences.

Whether you have been arrested for a misdemeanor or a felony DUI, you need to take every consequence seriously, hire a skilled Los Angeles DUI Defense Attorney and pursue the best options available to you.

Los Angeles DUI Penalties

If you have been arrested for driving under the influence, here are the list of possibly consequences you are facing (each of which is a sign of how important it is to have an experienced Los Angeles DUI Defense Attorney fighting on your behalf):

  • Jail time - this is the scariest reality.  Usually, only major infractions will lead to jail time, but multiple DUI misdemeanors can also lead to at least some prison time.  Even famous and powerful individuals such as Paris Hilton and Lindsay Lohan have spent time in prison for drunk driving, and if their millions couldn't buy their way out of jail, what chance do you have without a skilled lawyer?
  • Fines - this is actually one of the trickiest areas of the DUI process.  A fine might be $1,000, but with "taxes" that number can double of triple very fast, making a small fine an extreme amount for anyone on a budget.  Fines can range from hundreds of dollars to thousands of dollars depending upon the nature of your charge, but either way they will weigh heavy on your bank account.
  • Loss of license - in the DMV process, you can lose your license for six months, 1 year or more.  Losing your license is a serious issue, especially if you are the main bread winner in your home.  Losing your ability to drive just is not an option, meaning you will need an effective Los Angeles DUI Defense Attorney to protect against this particular penalty.
  • Interlock Device - imagine having to blow into a device in your car before you start it up.  Imagine being at your office or place of work and having people watch you blow into the device every time you start your car.  The public embarrassment and general frustration of dealing with such a situation can be unbearable.

These are just some of the drunk driving penalties awaiting anyone convicted of driving under the influence.  If your or someone you love has been arrested for, charged with or accused of a drunk driving incident, contact the Los Angeles DUI Defense Attorneys at Kestenbaum Eisner & Gorin, LLP today by calling 877-781-1570.

DUI Crimes in the City of Bell

| No Comments | No TrackBacks

With the city of Bell currently facing a serious scandal involving the pay of city officials, the last thing it needed was further bad news regarding drunk driving accusations.  However, the city manager of Bell, Robert Rizzo, was sentenced to receive alcohol counseling after being arrested in March for a serious Los Angeles DUI.

Rizzo was arrested for DUI when he showed a blood alcohol content of 0.28, which is more than three times the legal limit of .08.  A resident told police that Rizzo crashed his care into their mail box and then drove into an alley.  He was charged with misdemeanor drunk driving, faces up to six months in jail and a loss of license.  Mr. Rizzo's DUI Defense Attorney has been working with him, and he even submitted himself to personal counseling after his DUI Arrest.

For anyone charged with driving under the influence, having a skilled Los Angeles DUI Defense Attorney on your side is invaluable.  A conviction for drunk driving will affect more than just your driving record, a stark reality for far too many people.  Without proper legal representation, you could face the loss of your driver's license, prison time, public embarrassment, heavy fines, having an interlocking device placed on your car and much more.  The public shame could also cost you your job, especially if you are a public figure, or a state employee such as a school teacher, politician or even a janitor.  The punishment for any DUI, felony or misdemeanor, is severe and without proper legal assistance, you could be facing a long hard road.

At Kestenbaum Eisner & Gorin, LLP, our Los Angeles DUI Defense Attorneys have over 50 combined years of experience with drunk driving charges.  While public figures such as Mr. Rizzo have to face the piper for all sorts of problems, you do not have to face the same public scrutiny.  A skilled attorney can help keep you out of jail, free from fines and can also help you protect your future.  Recent examples such as Lindsay Lohan demonstrate just how real the punishment is for anyone who tries to flaunt the criminal justice system.  Even wealth celebrities go to jail for DUI, including Ms. Lohan, Parish Hilton and others.

Los Angeles DUI Defense and...Lebron James

| No Comments | No TrackBacks

Recently, the world of professional basketball witnessed an unmatched spectacle when countless high level free agents were on the market at the same time.  Names such as Dwyane Wade, Chris Bosh, Amare Stoudemire and, of course, Lebron James, were just some of the big names on this year's NBA free agent list, spawning fans to root hard for their teams to make a splash.  When Lebron signed with Miami, some fans were angry, others were distraught.  One individual however chose to use it as a defense for his drunk driving charge.

Police pulled a man over around 2:40 AM after watching him swerve on the road.  When the man was asked if he had been drinking, he admitted that he had, because LeBron James had decided to play for the Miami Heat instead of the Boston Celtics.  A Breathalyzer Test revealed the driver's blood alcohol content to be .61, which is twice the legal limit.  Apparently, he was so drunk he did not realize that LeBron was never going to sign with the Celtics, it was the Cavaliers he had played with before.

When a Los Angeles DUI Defense Attorney represents someone, he usually encounters an individual who is under a great deal of stress, or who is distraught over some tragedy.  When a California politician was pulled over for a DUI, it turns out that individual had been hiding the fact that he was gay from his friends and family, as well as the voters in his region.  Others battle alcohol addictions due to the loss of a job (quite common these days) or because there is family trouble due to a divorce, deceased loved one or something else.  The courts and the police will not care about such circumstances unless a Los Angeles DUI Defense Attorney does his job and makes the court aware that his client is not simply an out of control individual.

If you or someone you love is facing a DUI charge, contact the Los Angeles DUI Defense Attorneys at Kestenbaum Eisner & Gorin LLP today by calling 877-781-1570.  With over 50 years of combined experience representing clients in and out of court, they have the knowledge, skill and successful track record necessary to help you avoid jail time and heavy fines.

Los Angeles DUI Defense and Lindsay Lohan

| No Comments | No TrackBacks

There may be no greater example of how complex, drawn out and tragic driving under the influence charges can be than the case of Lindsay Lohan.  There are so many outside factors involved in this case, and Ms. Lohan pushed the law so far that even a skilled Los Angeles DUI Defense Attorney was having a hard time keeping her out of prison.

As a result, Ms. Lohan was sentenced to 90 days in jail as well as 90 days in an inpatient rehab.  Lindsay has until July 20 to turn herself into authorities, and beginning her jail sentence.  Most likely she will not serve every day of the 90 day sentence for driving under the influence in Los Angeles, but she will likely serve at least 20+ days of it.  Her Los Angeles DUI Defense Attorney fought long and hard for the former teen starlet, even while Lilo (as the paparazzi call her) painted curse words on her fingers nails and made it difficult for herself throughout the process.  She will serve her sentence at Lynwood California's Century Regional Detention Facility, where she served 84 minutes of a previous drunk driving related sentence in 2007.  Paris Hilton and Nicole Richie also served time for their drunken driving charges there.

The LA Sheriff's Department says that the average female inmate in Lohan's situation will serve at least 25 percent of her sentence, which would mean roughly 23 days.  She may also be facing a contempt of court charge for painting "F*** U" on her nails while her Los Angeles DUI Defense Attorney was trying to keep her out of prison.  That charge could lead to three to five extra days in jail for her.

Lindsay Lohan has Multiple DUI convictions, and was recently fitted with a SCRAM ankle bracelet which detects how much, if any, alcohol the wearer was drinking.  If the alarm goes off before her jail sentence, it could lead to even more jail time.  It has been a disastrous time for the young actress, however she disobeyed the courts, made life more complicated for herself and even made life so difficult for her Los Angeles DUI Defense Attorney that she quit!  While driving under the influence in Los Angeles can be prosecuted in far too harsh a manner, there are simple things any defendant can do to make sure they give themselves the best chance of avoiding jail time.  For example:

  • Don't be late to court
  • Submit yourself willingly to Alcoholics Anonymous meetings before your trial
  • Closely listen to and obey they counsel of your Los Angeles DUI Defense Attorney

DUI Charges in All Walks of Life

| No Comments | No TrackBacks

When a Los Angeles DUI Defense Attorney represents someone, he knows it could range from an 18 year old known for partying, or a 60 year old grandparent.  Two recent drunk driving cases demonstrate how anyone in any walk of life can be in need of an experienced Los Angeles DUI Defense Attorney.

Beverly Palmer, who was a contestant in VH1's "Rock of Love" was officially charged with two counts of DUI in early July.  While Beverly failed to win Brett Michael's heart, she was allegedly drinking heavily when she crashed into another car in Hollywood in May.  She was charged with driving under the influence and driving with a blood alcohol level of .08 or higher.  If convicted, she could face up to six months in jail and a fine of up to $1,000.  There have been no comments from her Los Angeles DUI Defense Attorney.

In another high profile drunk driving case, Damon Evans, the now former Athletic Director at the University of Georgia was arrested for DUI which involved a drunk and disorderly 28 year old female passenger who was not his wife.  At a news conference, Evans suggested he may have been having an affair with the woman as he apologized to his wife.

Motley Crue Singer Busted for Drunk Driving

For Los Angeles DUI Defense Attorneys, representing high profile individuals is simply a way of life.  With so many celebrities in the city, musicians, actors, athletes, etc., reading about a famous person arrested for DUI is common place.

Recently, Motley Crue lead singer Vince Neil (actual name is Vincent Neil Wharton) was allegedly "smashed" before his drunk driving arrest according to celebrity tabloid TMZ.  Before he was arrested for a DUI, he was a suspect in a camera smashing incident earlier that same evening.  Just before midnight, a woman reported that Neil had snatched her camera and destroyed it after she took his picture.  Authorities were searching for Neil when they subsequently arrested him on suspicion of driving under the influence.

Supposedly the singer had been sober for three years.   Officers detected alcohol and he was given a field sobriety test and was subsequently placed under arrest for suspicion of DUI. Neil posted bail within the hour by his wife.  Like many of the clients represented by Los Angeles DUI Defense Attorneys, Neil has a long history of battling alcohol demons.  In 1984, Neil was charged with vehicular manslaughter and DUI in connection with a crash that killed a member of a different band.  At the time, Neil's BAC was .17.

New Los Angeles DUI Laws

| No Comments | No TrackBacks

Los Angeles DUI laws are tricky, often favoring police and putting the accused in a difficult position.  Throughout the city, it is vitally important to have a skilled drunk driving defense attorney representing you in any case, because prosecutors and police have a bit of a stacked deck.

A new law that goes into effect July will put alleged drunk drivers into an even more difficult position.  In a new test program, people convicted of a Los Angeles DUI will have to test their breath for alcohol before they can start their vehicles. This is a pilot program being implemented in LA, Sacramento, Tulare and Alameda counties.  The law was signed last year by Governor Arnold Schwarzenegger and requires drivers to breath into a tube to start their vehicles and at random intervals while driving.  Normally, drivers with Multiple DUI Convictions have to get interlock ignition devices, but this program will require first time offenders to use the device for five months (or one year if someone has been injured).  A second offense would require using the device for a year and a third offense would require the device for two years.

Those convicted of a Los Angeles DUI are expected to pay for the device and its monthly rental fees.  Los Angeles DUI Defense Attorneys, restaurant industry lobbyists and others have invested a great deal of time fighting this program, saying the device should be reserved for repeat drunk driving offenders.  Gauging how much alcohol is too much might be too difficult, according to these lobbyists.

Any Los Angeles DUI trial that involves the potential of an interlocking device being placed on your car requires a lawyer who knows the law forwards and backwards.  Los Angeles DUI trials involve:

  • Opening statements
  • Examination and cross-examination of witnesses
  • Closing arguments
  • Evidence
  • Expert witnesses
  • And much more

Only an experienced, knowledgeable and successful Los Angeles DUI Defense Attorney can be trusted to craft the best defense possible for your case.  If you or someone you love has been arrested for, charged with or accused of a Los Angeles DUI, contact our lawyers at Kestenbaum Eisner & Gorin, LLP at 877-781-1570.  We will examine your case, perform as much research as possible, fight for your freedom and do everything we can to protect your future.  Instead of giving into the possibility of fines, interlock devices, jail time and the public shame, contact an attorney who knows how to get the results you need.
